LIVE IT UP TRAVELS (LIUT)
TERMS & CONDITIONS
These Terms & Conditions (“Agreement”) govern the relationship between Live It Up Travels (“LIUT,” “we,” “our,” or “us”) and the traveler(s), client(s), purchaser(s), and any individual traveling under a reservation made through LIUT (“Client,” “Traveler,” “you,” or “your”). By requesting quotes, authorizing bookings, submitting payments, or traveling on an itinerary arranged by LIUT, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
AGENCY STATUS
Live It Up Travels acts solely as an independent travel advisor and booking agent for airlines, cruise lines, hotels, resorts, vacation package providers, tour operators, transportation companies, and other travel suppliers (“Suppliers”). LIUT does not own, operate, manage, or control any Supplier. All transportation, accommodations, tours, cruises, and travel services are provided by independent Suppliers that maintain their own terms, conditions, rules, and policies. LIUT is not responsible for the acts, omissions, errors, delays, injuries, losses, damages, schedule changes, cancellations, overbookings, strikes, weather events, bankruptcies, or service failures of any Supplier.
USE OF LIUT SERVICES
You represent and warrant that you are at least eighteen (18) years of age and possess the legal authority to enter into this Agreement and make travel reservations. You agree to be financially responsible for all travel bookings made through LIUT on behalf of yourself and all members of your traveling party. You further warrant that all information supplied to LIUT is accurate and complete.
All reservations are accepted subject to the terms and conditions of the Suppliers providing the travel services. By booking travel through LIUT, you agree to be bound by both these Terms & Conditions and the terms and conditions of each Supplier included in your itinerary.
PRICING, QUOTES, AND AVAILABILITY
All pricing, promotions, and availability are subject to change until a deposit or payment has been received and confirmed by the Supplier. Suppliers reserve the right to increase prices, impose fuel surcharges, taxes, fees, or modify promotional offers without notice. LIUT is not responsible for changes in Supplier pricing after quotes have been provided.
LIUT reserves the right to correct pricing errors, omissions, or inaccuracies at any time.
PROFESSIONAL SERVICE FEES
LIUT provides professional travel planning and consultation services. Certain travel arrangements may require a non-refundable planning, research, consultation, booking, itinerary design, group management, airfare research, destination wedding, cruise planning, or custom itinerary fee. Any applicable fee will be disclosed before services are rendered or payment is collected.
Professional service fees compensate LIUT for time, expertise, and planning services and are non-refundable once work has commenced.
PAYMENTS, CANCELLATIONS, AND CHANGES
Full payment is required according to the terms established by the Supplier. Failure to make payments by the due date may result in cancellation of your reservation and forfeiture of funds.
All cancellations must be submitted in writing. In addition to any cancellation penalties imposed by Suppliers, LIUT charges a $25.00 administrative cancellation fee per reservation. This fee is separate from any Supplier penalties and is non-refundable.
Supplier cancellation penalties may range from partial loss of funds to forfeiture of all monies paid. Refunds, if any, are governed solely by Supplier policies. LIUT does not control Supplier refund decisions and cannot guarantee refunds under any circumstances.
Changes requested after a reservation has been confirmed may be subject to Supplier fees, fare increases, penalties, and additional LIUT service fees.
CREDIT CARD AUTHORIZATION AND CHARGEBACKS
By authorizing payment, you permit LIUT to process payments for travel services and professional fees. Except in cases of fraud, you agree not to initiate chargebacks, payment disputes, or reversals for valid charges associated with services rendered by LIUT or its Suppliers.
In the event of an improper chargeback or payment dispute, LIUT reserves the right to recover all collection costs, attorney fees, court costs, administrative expenses, and outstanding balances associated with the dispute.
TRAVEL DOCUMENTS
It is the sole responsibility of each traveler to obtain and carry all required travel documents, including passports, visas, travel authorizations, vaccination records, REAL ID-compliant identification, and any other documentation required by domestic or international authorities.
Many countries require passports to remain valid for at least six (6) months beyond the date of travel. Non-U.S. citizens may have additional requirements.
The name on all travel documents must exactly match the name on the travel reservation. Failure to provide accurate information may result in denied boarding, denied entry, cancellation of travel arrangements, or additional costs.
Upon receipt of travel documents, confirmations, invoices, or tickets, travelers must review all information immediately and notify LIUT of any errors within twenty-four (24) hours. LIUT is not responsible for costs associated with corrections that are not reported within this timeframe.
ENTRY AND EXIT REQUIREMENTS
Each traveler is solely responsible for determining eligibility to enter, exit, or transit through any country included in their itinerary. Entry and exit requirements vary by country and may change without notice.
Certain countries may deny entry based upon criminal convictions, felony convictions, DUI or DWI offenses, drug-related offenses, immigration violations, outstanding warrants, unpaid child support obligations, customs violations, or other legal restrictions. For example, Canada may deny entry to travelers with certain DUI convictions or criminal records.
LIUT does not investigate a traveler’s eligibility to enter any destination and assumes no responsibility if a traveler is denied boarding, denied entry, detained, deported, refused a visa, refused re-entry into the United States, or otherwise prevented from traveling due to legal, immigration, or governmental restrictions.
MINORS TRAVELING
Parents and legal guardians are responsible for ensuring that minors possess all required travel documents. Certain countries and transportation providers require notarized consent forms when a minor travels with only one parent, a grandparent, another relative, or without both parents. Failure to provide required documentation may result in denied boarding or denied entry.
AIR TRAVEL, SCHEDULE RECONFIRMATION, AND CHECK-IN
Your airline ticket is a contract between you and the airline carrier, even when purchased through LIUT. Airlines are independent Suppliers over which LIUT has no control.
LIUT is not responsible for airline schedule changes, delays, cancellations, missed connections, seat assignments, baggage handling, baggage fees, airline bankruptcy, labor disputes, weather disruptions, fuel surcharges, or any other airline operational matters.
LIUT may provide courtesy assistance with online airline check-in when requested; however, travelers remain solely responsible for ensuring they are properly checked in, have obtained boarding passes, have selected seats if desired, and have complied with all airline requirements.
LIUT is not responsible for missed flights resulting from airline website outages, failed check-in attempts, late arrival at the airport, schedule changes, incorrect passenger information, or traveler error.
Travelers are encouraged to reconfirm flight schedules directly with the airline prior to departure and arrive at the airport no less than two (2) hours before domestic departures and three (3) hours before international departures.
HEALTH REQUIREMENTS
Travelers are responsible for obtaining all required vaccinations, health screenings, prescriptions, and medical documentation required by any destination. Health requirements may change without notice. LIUT recommends travelers consult the Centers for Disease Control and Prevention (CDC), the U.S. Department of State, and applicable foreign government agencies before departure.
TRAVEL INSURANCE
Travel insurance is strongly recommended for all travelers. Travel insurance may provide protection for trip cancellations, interruptions, delays, medical emergencies, emergency evacuation, lost baggage, supplier bankruptcy, and other unforeseen circumstances.
If travel insurance is declined, the traveler assumes full financial responsibility for any losses associated with cancellation, interruption, delay, illness, injury, weather events, supplier default, or any other unforeseen event.
FORCE MAJEURE
LIUT shall not be liable for delays, cancellations, interruptions, losses, damages, or additional expenses resulting from events beyond its control, including but not limited to acts of God, hurricanes, floods, wildfires, earthquakes, severe weather, pandemics, epidemics, quarantines, government actions, border closures, acts of terrorism, civil unrest, labor strikes, transportation disruptions, supplier insolvency, or other unforeseen events.
Refunds and credits resulting from such events remain subject solely to Supplier policies.
LIMITATION OF LIABILITY
LIUT acts solely as an intermediary between travelers and Suppliers. LIUT shall not be liable for any personal injury, death, property damage, property loss, delay, inconvenience, emotional distress, missed connection, supplier default, supplier bankruptcy, travel interruption, or any other loss arising from the acts or omissions of Suppliers or circumstances beyond LIUT’s control.
Any recovery against LIUT shall be limited to the amount of professional service fees actually paid directly to LIUT. Under no circumstances shall LIUT be liable for consequential, incidental, indirect, special, exemplary, or punitive damages.
CLIENT CONDUCT
Travelers are expected to behave respectfully toward suppliers, staff, crew members, guides, and fellow travelers. Suppliers reserve the right to refuse service, remove, or deny boarding to any traveler whose conduct is disruptive, dangerous, illegal, abusive, or otherwise inappropriate. No refund shall be provided for services missed or terminated as a result of traveler misconduct.
GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California and applicable federal laws of the United States. Any dispute arising from these Terms & Conditions shall be resolved exclusively in a court of competent jurisdiction located within the State of California.
ACCEPTANCE OF TERMS
By requesting a quote, authorizing a reservation, submitting payment, providing a credit card authorization, or traveling on an itinerary arranged by Live It Up Travels (LIUT), you acknowledge that you have read, understand, and agree to these Terms & Conditions. These Terms & Conditions constitute a binding agreement between you and Live It Up Travels.
Live It Up Travels reserves the right to modify these Terms & Conditions at any time without prior notice. The most current version shall govern all bookings and travel arrangements.
